How to file a claim in the Fabulouso class action lawsuit.
You must file a claim by March 13, 2024. To file a claim:
- Head on over to the settlement website.
- If you receive a notice in the mail or email with a claim number, you can enter it on the left side of the screen.
- If you did not receive a notice, choose the “Click Here” button on the right side of the screen.
- Follow the prompts to enter your personal information and upload any proof of purchase you may have (you can still submit without proof).
A final hearing for approval is scheduled for April 25, 2024. Payments will be distributed once any appeals have been settled.
Other options besides submitting a claim:
- Opt out of settlement by March 13, 2024 – You will not receive a payment but you will retain your right to sue over this matter at another time.
- Object to settlement by March 13, 2024 – You may object to the settlement in writing, but can still file a claim in this case.
- Do nothing – You will not receive a payment and you give up your right to sue at another time.

Why is there a Fabuloso class action lawsuit against Colgate-Palmolive?
In February of 2024, Colgate-Palmolive voluntarily recalled some Fabuloso products due to a preservative not being added appropriately during manufacturing. Lacking the appropriate levels of preservative created a risk of bacteria growth including Pseudomonas aeruginosa and Pseudomonas florescens. This bacteria does not usually affect healthy individuals but may pose a risk to those immunocompromised.
The lawsuit alleged that Colgate-Palmolive was deceptive regarding manufacturing, marketing, and selling these products. The court did not determine any wrongdoing. However, both parties agreed to a settlement to minimize the costs of litigation.
