StarKist Tuna Class Action Settlement: Request Up to $25 Check or $50 Worth of Free Starkist Products

Did you purchase at least one Starkist Chunk Light in Water or Oil 5oz OR Solid White in Water or Oil in the United States between Feb. 19th, 2009 and Oct. 31st, 2014? If so, you qualify for up to a $25 check or $50 worth of FREE Starkist products via the StarKist Tuna Class Action Settlement.

To submit your claim, head here and complete the form no later than November 20th, 2015. You can also request that a copy of the claim form be mailed to you by calling 1-888- 643-6376. You may choose to receive either a cash refund or a voucher for free products. Click here for more information.

Are you wondering what this lawsuit is about? According to the StarKist tuna class action lawsuit, which was filed in February 2013 by plaintiff Patrick Hendricks, federal law requires 5-ounce cans to contain an average of 2.84 to 3.23 ounces of tuna. However, Hendricks alleges that 5-ounce cans of StarKist tuna only contain an average of 2.81 to 3.11 ounces of tuna.

Hendricks claims he would not have purchased the StarKist tuna products if he had known they did not contain an adequate amount of tuna for a 5-ounce can. He filed the class action lawsuit on behalf of himself and a Class of consumers who purchased the allegedly under-filled cans of StarKist tuna.

      they also found out that McCormick pepper cans contained less in the same size can. A new class action suit should appear soon over that.

    I tried to file a claim. It printed out a 11 digit number. To continue the filing, it states to list the 9 digit claim number provided. It this a way to keep the claims down?

      L Berkeley were you submitting your claim online? If so, select the button that’s for online and says you don’t already have a claim number. Once completed, you will be assigned a Claim Number.

    OMG Seriously someone sued over that? Geez, what is wrong with people? That is so wrong in so many ways. Class action suit over maybe .03 oz. of Tuna. Unbelievable.

      I applaud this person, as we are all being mislead as consumers the way they have shrunk everything, trying to make us think differently! A former half gallon of ice cream is two full cups less now. The sizes of pizzas are still labeled XL, LG and so on but they are actually made in smaller pans, etc. EVERYTHING has shrunk, but they package it to make it look larger…and this is just plain wrong! So, good for the person who went to the trouble to address a big consumer frustration!

      I can sue you if I PURPOSELY mislead. Do you hate when your kids lie to you? Starkist and so many USA companies are making billions by cutting back on what they promise. And don’t you hate people who break their promise. Potato chip companies do this all the time.

    I think what probably happened was he was concerned it wasn’t 5 oz of tuna. Then found out part of the weight was water. By that time, he had already tediously separated and weighed the tuna and was covered in stank tuna juice. Dammit all I’m still suing! LMAO!

    My husband has purchased a lot of them as he eats tuna about 4 times a week. I have purchased several at Sam’s Club. All have been Starkist tuna in water, not albacore.

    Starkist is not too cheap compare other brands and to top it off the company gives less of the amount as advertised..not fair for our pockets.I’m glad someone did something about.

    The website is down. Does that mean that they are no longer honoring their commitment to the consumers?

      I just checked and was able to access the website to file a claim. (I didn’t complete the process though, as I filed yesterday.) I will say it’s ALL over Facebook and has been a top trending news topic. So, I’m sure their website has been busy.

      It’ll be interesting to see what the final claim amount is, as they allotted $8 Million for Checks. So, 32 Million could file claims and still get $25, but as more people file beyond 32 Million, that $25 estimate will drop.

    I filed my online claim and received a claim number that I mistakenly didn’t write down. They never sent a confirmation email. Was I supposed to file with my claim number after I received it or just wait for the claim…

    I filed my claim with Hendricks v starkist regarding a $50 voucher for my problems with the tuna I was directed to print out a claim form receipt that says award selection of $50 product voucher, is this my voucher that I give to the stores when I shop for more tuna?

      The air in the chip bags is to protect the chips from breaking. The amount of chips, measured by weight not volume, is in the bag. I believe there is a comment on the bags that states this

    Sorry consumers….my wife spoke to the lawyer handling the StarKist class action. His name is Neal Deckant of Bursor & Fisher. Apparently Neal didn’t do his homework and only asked for 12million, which is nothing to a multi billion corporation like StarKist. And because of his lack of foresight….the $25 check has now been reduced to $2 to $3!!! As for the $50.00 in StarKist coupons…
    That’s been reduced to (1) voucher for less than $5!!! What a fraudulent way to get consumers involved in their lawsuit. Naturally the law firm gets their share. My sister is working to fight the low settlement and will appear at the SF Superior Court on December 17, 2015 to speak on behalf of the consumers. If Judge Haywood Gilliam increases the settlement amount everyone will probably get one of the original options. **Give her your support.

    how do we get more info about your wife’s blog? I don’t see the info on how to help her. I am outraged at this settlement amount as it is nothing but a slap on the wrist for Starkist and lots of money in the pockets of the attorneys and not much for the consumers who were ripped off.     I opted for the tuna, haven’t received anything. I say don’t buy starkest. The best canned tuna brand is Polar. Hard to find Polar in most grocery stores. People should tell the stores to stock Polar tuna, it is the best.

      I also have heard nothing and I put in a claim last August. I think there has been an appeal. Final court date is slated for April 21, 2016 or so it seems.

    I’m pissed I filled out all the forms when this went public about 2 years ago around then an they never made good on the cans of tuna they where gonna send me. An Sunkist says that’s not my problem a lawyer his handling it but I can’t find this lawyers firm to get in touch they have it on Sunkist the firm but no email address. FUNNY

    I just saw this in my memories on facebook. I opted for the $50 in tuna back on the first day we were able to file. I have not received anything or heard anything. I forgot aboyt this actually until i just read and saw the fb memories.

    After all this time, I got a deposit to my PayPal for a whopping 2.38 for Starkist class action lawsuit. I had forgotten about it and have never received one to PayPal before.

    I opted for the product and received a coupon for $5.03. They said that they had originally planned on about 200k claimants and due to coupon sites/blogs they received millions.

      I also received $5.03. I got out out of the mail box this weekend, but it could have been in the box for a week or two. It specifies you need to buy at least 3 products to use it.
