Have you bought a Celsius drink in the past 7 years? Here’s the scoop on the class action lawsuit.

hand holding can of sparkling water

A class action lawsuit against Celsius has been settled.

The popular beverage company, Celsius, has found themselves in hot water for false advertising. A recent class action lawsuit, Hazi vs. Celsius Holdings, Inc., alleged that the beverage company mislabeled its products as having “No Preservatives.” It turns out that the drinks contained citric acid which Celsius claimed was for flavor only.

Instead of hashing it out in court, the two parties decided to settle. Though the court may not have ruled in anyone’s favor, consumers are still entitled to a cash payout. 💵

Do you qualify to receive a cash settlement from the Celsius lawsuit?

You qualify to be a Class Member if you can answer “yes” to ALL of the following questions:

  • Are you a United States Citizen?
  • Have you purchased Celsius for personal or household consumption (not for resale or distribution)?
  • Did you purchase your Celsius drink between January 1, 2015 and November 23, 2022?
  • Did you purchase one or more of the Celsius beverages listed below?
    • Celsius Live Fit
    • Celsius Heat
    • Celsius BCAA + Energy
    • Celsius with Stevia
    • Celsius On-The-Go Powdered Drink
    • Flo Fusion Powdered Drink

If you said “yes” to all of those questions, you’re entitled to a cash payout! 💰

How much money are you eligible to receive from the Celsius lawsuit?

If you qualified as a Class Member, you’re entitled to a cash award. For every single canned beverage you purchased, you’re entitled to $1 per can. If you purchased a 14-pack of the Celsius-On-The-Go or Flow Fusion powdered drinks, you’re entitled to $5 per pack. The maximum amount you can claim WITH RECEIPTS is $250. If you can no longer find your receipt, you may be able to get a cash award of $20 per household.

If you shopped in-person at a grocery store, you may not be able to find your receipt. We recommend you check to see if you’ve purchased Celsius drinks online. Places like Amazon may have your order history that proves you’re entitled to a higher cash award.

How do you file a claim?

You must file a valid claim in a timely manner. Visit www.CelsiusClassActionSettlement.com to submit a claim. You can file electronically right on the website. If you prefer to send your paperwork snail mail, you can print the form and send it to:

Celsius Class Administrator
P.O. Box 4325
Baton Rouge, LA 70821

The deadline to postmark or submit your claim is February 13, 2023.

What if you want to Object or Opt-Out of the settlement?

You have the right to object to the settlement or Opt-Out of the settlement.

When you object, it means that you want to participate in the class action lawsuit but you disagree with something about the settlement. The deadline to object is also February 13, 2023. There are strict guidelines you must follow to submit your objection. See those full guidelines on the Class Action Settlement website. You will also have the option to appear at the Fairness Hearing on March 31, 2023 to state your objections.

You are also able to Opt-Out of the settlement. This means you wish to keep your right to sue Celsius Holdings, Inc. If you choose this route, you will NOT receive a cash award from this settlement. You also cannot object to the settlement. You must file or postmark your exclusion request by February 13, 2013. For more information see the Class Action Settlement website.

If you still have questions, visit the Class Action Settlement Website, contact Class Counsel at info@clarksonlawfirm.com, or call the Class Administrator at 1-855-737-1258.

Is anyone else having trouble uploading proof of purchase? I scanned the receipts/invoices I had into a PDF file, but it doesn’t show that the upload is going through. I don’t want to submit my claim without it and get capped at $20.

    • Jessica (Hip Sidekick)

Hey Laura! I tested this earlier and was able to upload the PDF. You might try splitting it up into smaller files, if it’s in one larger one. If still having trouble, you might try switching to a different browser. Hoping this does the trick! 🤞❤️

      • Laura

Thank you! Splitting it into two smaller files did the trick:)

Just my 2 cents; but citric acid is not “harmful” (it is present in all citrus fruits); it has its use as a preservative; but mainly it is used to give a lemony or sour flavor.

I for one will not be submitting for any claims; because it is a flavor additive!

Thanks for taking a moment to share your thoughts with us!🥰

  4. Liz

Just submitted mine, using Walmart & Target purchase history (we’ll see if they approve them), Costco let me print an actual copy of the receipts! If only I had proof of the rest of my purchase.

    • Claudette (Hip Sidekick)

Hey Liz! Come back and let us know what they accepted and how the process went. Hoping they accept the purchase history!🤞

  6. Brooke Hunsinger

When will we get the money after we submit the form?

    • Claudette (Hip Sidekick)

Hey Brooke! I found the following on their FAQ page. “Payments will be sent to Class Members who send in Valid Claim Forms on time, after the Court grants “final approval” of the Settlement, and after the time for appeals has ended and any appeals have been resolved. If the judge approves the Settlement after a hearing on March 31, 2023 (see the section “The Court’s Fairness Hearing” below), there may be appeals. Resolving these appeals can take time. Please be patient.” Hope that’s helpful.đź’—

    Fingers crossed!!

Anybody hear anything about this? @hip2save

    • Jessica (Hip Sidekick)

Hey Mel! I found this in the FAQ on the settlement – “Payments will be sent to Class Members who send in Valid Claim Forms on time, after the Court grants “final approval” of the Settlement, and after the time for appeals has ended and any appeals have been resolved. If the judge approves the Settlement after a hearing on March 31, 2023 (see the section “The Court’s Fairness Hearing” below), there may be appeals. Resolving these appeals can take time. Please be patient.” In previous claims that I have been eligible for and submitted, I’ve seen payment in about 6 months after filing, but each one has been different. Hoping this might be helpful! ❤️
