Kellogg’s Is Facing a Berry Curious $5 Million Lawsuit Over Their Strawberry Pop-Tarts
Kellogg’s is in a bit of a jam regarding their Strawberry pop tarts. 🍓
USA Today is reporting that Kellogg’s is getting popped with a lawsuit over the ingredients of its strawberry-flavored Pop-Tarts.
A lawsuit has been filed against Kellogg’s by a consumer named Anita Harris in the Southern District of Illinois. She alleges that the company is misleading people by promoting Pop Tart’s strawberry filling in its labels and marketing, leading consumers to believe that the fruit filling contains “a greater relative and absolute amount of strawberries than it does.”
Ms. Harris claims that Pop-Tarts “cannot provide a true strawberry taste” since any strawberries are overpowered by “significant amounts” of pears and apples. She’s also claiming that red food coloring gives consumers “the false impression” that the pastries contain more strawberries than they actually do. 😱
The product’s nutrition label shows that the frosted strawberry toaster pastries contain 2% or less of dried strawberries, dried pears, dried apples, and red 40, but Harris’ lawsuit says that if she had known the truth, she would not have bought the Pop-Tarts at the price she paid. 😜
Ms. Harris’ original lawsuit has now evolved into a class-action lawsuit open to consumers in New York, Kansas, Wyoming, and Delaware who purchased Pop-Tart brand Whole Grain Frosted Strawberry Toaster Pastries.
Kellogg’s has yet to respond to this legal action, but it’s interesting to note that the same attorney filed a similar lawsuit against the company last year. Kellogg’s filed a motion to dismiss that lawsuit, stating:
“The confusion the plaintiff claims to have suffered does not pass the straight-face test.” 😁

Why do we care?
That’s pretty ridiculous for a lawsuit, but why are they even putting pears and apples?? The fruit is only 2% of the product so it’s not like they would need a lot of “dried” š¤¢ strawberries.
These lawsuits are ridiculous. I am absolutely for a class action lawsuit that holds companies accountable *when there is a safety issue* at play. Food coloring, little to no fruit in colorful packaging….ummm sounds like majority of the packaged snack items sold in out country. Pretty simple, feed your family what you want and don’t feed them what you don’t approve of. Sure was a good laugh though!
My guess is, she has a kid who claims he ate strawberries for breakfast and she was tired of arguing with him. lol
I’m sorry but I can’t believe that anyone who buys Pop Tarts thinks they’re really going to find any significant amount of actual fruit in there. They’re junk food!
True, they are junk food but they are an occasional indulgence I still justify with the “fruit” content so I’m going to go ahead and turn a blind eye to the nutrition facts. LOL!
Honestly so tired of people suing for anything and everything. This is is perfect example of how ridiculous it has become. Read the label and do your homework before consuming or purchasing. If you don’t like what you find out then don’t buy it. It really is that simple.

I totally agree!! I have been caught by not reading the label but I donāt blame anyone but my self for that error. People need to take ownership for not reading the label instead of blaming the company.
Put this under the same column as dinkleberries that need a warning that hot coffee is going to be – hot. Not one person on this planet is going to actually believe that a Pop Tart is a legit source of fruit. These nonsense cash grabs are such a detriment to businesses.
I’m an attorney. We learned about the McDonald’s hot coffee case in depth in Llaw school. It was in absolutely no way frivolous. It’s interesting to learn about.

I feel like years ago there wasnāt the frosted variety ā or at least my mom didnāt buy them. And she always served them toasty hot with butter melted on top!

LOL! Was it Pop Tarts that was sued when a lady put one into her toaster and it got stuck and which led to a toaster fire years ago?

I don’t care how much strawberry is in there. I love them (the unfrosted strawberry ones that is)! They are so delicious right out of the package. I guess they will just have to change the flavor to strawberry, apple & pear. However, they can keep the red #40. I don’t need my strawberry poptarts to be red š
